Epic Games dropt een bommetje in gameland. Nadat het een nieuwe betaalmethode voor Fortnite op mobile had geïntroduceerd, waardoor spelers rechtstreeks aan Epic Games zelf konden betalen in plaats van via Apple of Google te gaan, werd Fortnite uit zowel de App Store als de Play Store verwijderd. Epic Games besloot daarop om zowel Apple als Google aan te klagen.
Het is duidelijk dat het hier om een geplande actie van Epic Games gaat. Het wist immers maar al te goed dat het met de introductie van de nieuwe betaalmethode de regels van Apple en Google overtrad, dus de verwijdering van de game was te verwachten. Daar was Epic Games ook op voorzien, want niet lang na de verwijdering werd meteen een rechtszaak opgestart.
Reactie Epic Games:
Apple unlawfully maintains its monopoly power in the iOS App Distribution Market through the anti-competitive acts described herein, including by imposing technical and contractual restrictions on iOS, which prevents the distribution of iOS apps through means other than the App Store and prevents developers from distributing competing app stores to iOS users.
Apple unlawfully maintains its monopoly power in the iOS App Distribution Market through its unlawful denial to Epic and other app distributors of an essential facility—access to iOS—which prevents them from competing in the iOS App Distribution Market.
To reach iOS users, Apple forces developers to agree to Apple’s unlawful terms contained in its Developer Agreement and to comply with Apple’s App Store Review Guidelines, including the requirement iOS developers distribute their apps through the App Store. These contractual provision unlawfully foreclose the iOS App Distribution Market to competitors and maintain Apple’s monopoly.
Apple has unlawfully maintained its monopoly in these markets through the anti-competitive acts alleged herein, including by forcing, through its contractual terms and unlawful policies, iOS app developers that sell in-app content to exclusively use Apple’s In-App Purchase, and preventing and discouraging app developers from developing or integrating alternative payment processing solutions.
To reach iOS app users, Apple forces developers to agree to Apple’s unlawful terms contained in its Developer Agreement, including that they use Apple’s InApp Purchase for in-app purchases of in-app content to the exclusion of any alternative solution or third-party payment processor. Further, Section 3.1.3 of Apple’s App Store Review Guidelines unlawfully prohibits developers from “directly or indirectly target[ing] iOS users to use a purchasing method other than in-app purchase”.
Apple is able to unlawfully condition access to the App Store on the developer’s use of a second product—In-App Purchase—for in-app sales of in-app content. Through its Developer Agreement and unlawful policies, Apple expressly conditions the use of its App Store on the use of its In-App Purchase to the exclusion of alternative solutions in a per se unlawful tying arrangement.
Bovendien werd via sociale media ook een video gedeeld door Epic Games waarmee men Apple (en daardoor ook Google) onder vuur neemt. De video is niet toevallig gebaseerd op een reclamefilmpje van Apple uit 1984, waarin Apple destijds zelf protesteerde tegen monopolieposities van grote bedrijven, iets waarvan ze nu zelf beschuldigd worden door Epic Games.
Epic Games heeft er naar eigen zeggen geen problemen mee dat games op iOS-toestellen uitsluitend via de App Store kunnen worden aangeboden, maar waar het wel een probleem mee heeft, is dat betalingen in deze games ook verplicht via Apple lopen, waardoor het bedrijf 30% van elke betaling voor zichzelf houdt. Dat is volgens Epic Games misbruik maken van een monopoliepositie.
Dezelfde redenering gaat min of meer op voor Google. Hoewel Fortnite op Android nog steeds beschikbaar is via een eigen launcher en bijvoorbeeld ook via de Galaxy Store van Samsung, heeft de Play Store van Google zelf toch een dominante rol op het platform, dus ook daar vindt Epic Games dat Google het niet kan maken betalingen verplicht via het eigen platform te laten verlopen, zeker niet als daar dan telkens 30% van wordt afgehouden.
Epic Games laat zijn spierballen dus rollen en gebruikt de gigantische winsten van Fortnite om het gaming landschap door elkaar te schudden, gelijkaardig als toen het de eigen Epic Games Store lanceerde om de machtspositie van Steam te breken. Hoewel het bedrijf stelt dat het deze strijd voert zodat alle gamers en developers er beter van zouden worden, is het natuurlijk toch vooral ook om zelf nog meer winst te kunnen overhouden dat deze acties ondernomen worden.
Zowel Apple als Google hebben reeds gereageerd op de actie van Epic Games. Ze stellen dat Epic Games de regels van de App en Play Store heeft overtreden en dat men dus niet anders kan dan Fortnite te verwijderen, al blijft men wel openstaan voor een dialoog met Epic Games om de situatie uit te klaren. Omtrent het punt van de 30% die afgehouden wordt en het misbruik van de monopoliepositie wordt niets gezegd.

Today, Epic Games took the unfortunate step of violating the App Store guidelines that are applied equally to every developer and designed to keep the store safe for our users. As a result their Fortnite app has been removed from the store. Epic enabled a feature in its app which was not reviewed or approved by Apple, and they did so with the express intent of violating the App Store guidelines regarding in-app payments that apply to every developer who sells digital goods or services.
Epic has had apps on the App Store for a decade, and have benefited from the App Store ecosystem – including it’s tools, testing, and distribution that Apple provides to all developers. Epic agreed to the App Store terms and guidelines freely and we’re glad they’ve built such a successful business on the App Store. The fact that their business interests now lead them to push for a special arrangement does not change the fact that these guidelines create a level playing field for all developers and make the store safe for all users. We will make every effort to work with Epic to resolve these violations so they can return Fortnite to the App Store.

The open Android ecosystem lets developers distribute apps through multiple app stores. For game developers who choose to use the Play Store, we have consistent policies that are fair to developers and keep the store safe for users. While Fortnite remains available on Android, we can no longer make it available on Play because it violates our policies. However, we welcome the opportunity to continue our discussions with Epic and bring Fortnite back to Google Play.
